Refund & Cancellation Policy

1. How billing works
Commission is billed once per month, at the beginning of the month, for commissions accrued in the prior month. Billing always follows delivery of the service.
2. Refunds
Because billing is in arrears, every billed amount relates to service already rendered in a completed month. Billed amounts are therefore not refundable. Where a billing error occurs — an amount billed that does not correspond to commissions actually accrued — the error is corrected and the difference credited or repaid within 10 business days of verification.
3. Cancellation — Flex (month-to-month)
Cancel with one calendar month’s written notice to team@phorm.fitness. The account remains active and billable through the end of the notice month; the account closes at the end of the notice period, and the final commission invoice follows at the start of the next month.
4. Cancellation — Annual (12-month commitment)
The Annual rate (7.5%) is granted in exchange for a 12-month term. Early cancellation is available on 20 business days’ written notice, subject to a reasonable cancellation penalty as contemplated by section 14 of the Consumer Protection Act 68 of 2008. There is no single penalty applied across the board: the amount is determined at the time of cancellation, on legal advice, having regard to the circumstances of the account — including the discounted rate enjoyed, the commissions processed during the term, and the notice given. On any cancellation notice, platform access ends at the end of the notice period.
5. Suspension for non-payment
Accounts more than 14 days in arrears may be suspended on written notice until settled. Suspension does not pause or restart the notice periods above.
6. Your statutory rights
Nothing in this policy limits your remedies under the Consumer Protection Act for services not rendered with reasonable skill and care.
